New Developments in Real Estate – What Litigators Need to Know

Panelists David Stapleton; Eric Rowen of Greenburg Traurig; John Spurling of Shumener, Odson & Oh; Douglas Wilson of Douglas Wilson Companies; and moderator Oren Bitan of Buchalter presented New Developments in Real Estate – What Litigators Need to Know at the USC Gould School of Law’s annual Real Estate and Business Forum.

Following extensive delays and court backlogs during the pandemic, litigation has resumed in full force, albeit in hybrid form. The pandemic, however, has led to a raft of litigation involving real estate. The panelists discussed litigation updates regarding pandemic related claims involving force majeure, attempts to invalidate contractual obligations in leases, loan documents, and purchase agreements, just compensation for inverse condemnation, and enforcement of court orders regarding real estate tenancies. The panel also discussed receivership updates, including a number of high profile megamansion receiverships in Southern California.
